These Terms of Service ("Terms") govern your use of MeshAura ("MeshAura", "we", "us"), including our website, generation tool, and API (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.
1. Who can use MeshAura
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account. You're responsible for the accuracy of the information you give us and for keeping your account credentials and API keys secure.
2. Acceptable use
The Service converts images you upload into 3D models. You agree not to upload, generate, or attempt to generate content that:
- depicts, sexualizes, or could reasonably be interpreted as depicting a minor in any sexual or suggestive context, in any style — photographic, illustrated, anime, or otherwise;
- is pornographic, sexually explicit, or intended primarily for sexual gratification;
- depicts non-consensual sexual content, sexual violence, or is otherwise obscene under applicable law;
- infringes someone else's copyright, trademark, right of publicity, or other intellectual property or privacy rights;
- depicts real people in a way intended to harass, defame, or deceive (including non-consensual likeness or "deepfake" use);
- promotes violence, terrorism, or illegal activity, or is otherwise unlawful in your jurisdiction or ours; or
- attempts to abuse, overload, reverse-engineer, or bypass the Service's security, rate limits, or content checks.
We use automated tools to screen images before generation. These tools are not perfect — they can miss violations and, less often, flag legitimate images. Passing an automated check does not make content acceptable if it otherwise violates these Terms, and we may remove content or restrict accounts based on manual review or a report, even if a system check did not flag it.
3. Enforcement
We may suspend or terminate your account, revoke API keys, remove generated content, and refuse service — without refund of amounts already billed for completed generations — if we reasonably believe you've violated Section 2. Where we're legally required to, we will report unlawful content (including content involving minors) to the relevant authorities.
4. Your content and ownership
You retain ownership of the images you upload. Subject to Section 2 and payment for the relevant generation, you own the 3D models MeshAura generates for you and may use them for personal or commercial purposes. You're responsible for having the rights needed to upload and use your input images.
You grant us a limited license to process your uploaded images and generated outputs solely to provide, maintain, and improve the Service (including automated content screening and troubleshooting). We don't claim ownership of your content.
5. Billing
MeshAura uses a prepaid balance and bills on a pay-as-you-go basis: you add funds to your account, and each successful generation deducts the cost of the compute that run actually used. Prices shown before you generate — on our pricing page and in the app — are estimates for a typical run and are not guaranteed; the amount charged may be higher or lower depending on your input. To reserve funds for a run we may temporarily hold an amount up to your available balance and adjust it to the final cost once the run completes. There is no subscription. Prepaid funds expire 6 months after your most recent top-up — any new top-up extends the whole balance for a further 6 months, and expired funds are forfeited and cannot be restored or refunded. Generations that fail due to a system or processing error are refunded to your balance automatically. Generations blocked under Section 2, or that fail because of an input you provided (e.g. an unfetchable image URL), are not refunded. Top-ups are processed by Stripe and are non-refundable once funds have been added, except where required by law.
6. API access
If you use our API, these Terms apply to everything you generate through it. You're responsible for all activity under your API keys, for keeping them confidential, and for any content generated using them, including by your own users if you build on top of the Service.
7. Disclaimers
The Service is provided "as is" without warranties of any kind. Generated 3D models are produced by an AI model and may contain inaccuracies, artifacts, or unexpected results; we don't guarantee any particular output quality, and generation times may vary.
8. Limitation of liability
To the maximum extent permitted by law, MeshAura is not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the 3 months before the claim arose.
9. Changes
We may update these Terms from time to time. If we make material changes, we'll update the effective date above. Continuing to use the Service after changes take effect means you accept the updated Terms.
10. Governing law
These Terms are governed by the laws of Australia, without regard to conflict-of-law principles.
